General Terms and Conditions

 

SECTION 1 - INTRODUCTION

These general terms and conditions (“Terms and Conditions”) are legally binding and apply upon registration for the Loop Circle reward program, organised by Loop BV.

By registering for Loop Circle reward program, you acknowledge the contents of these Terms and Conditions and accept them unconditionally. You also accept the documents referred to herein, including the Terms of Service, the Website Terms of Use, and the Privacy Policy. Participation is optional, and you may opt out at any time.

SECTION 2 - COMPANY INFORMATION

These Terms and Conditions have been drawn up by Loop BV, with its registered office at Lamorinièrestraat 33/105 2018 Antwerp, Belgium, with enterprise number 0665.977.551 (hereinafter referred to as “Loop”, “We”, “Us” or “Our”).

SECTION 3 - DEFINITIONS

"Loop Circle" refers to the customer loyalty and reward program organized by Loop BV.

"Member" means any individual who has successfully registered for Loop Circle.

"Points" are non-monetary virtual credits earned through eligible actions, which may be redeemed for specific rewards under these Terms.

"Rewards" refers to tangible or intangible benefits available through the program, such as discounts, products, or early access.

"Account" means the personal profile created by the Member to participate in the Loop Circle program.

"Benefits" include the features and entitlements associated with a Member's tier level, including but not limited to birthday points, shipping benefits, and customer support priority.

SECTION 4 - REGISTRATION

Loop Circle is available to individuals aged 18 years or older residing in Australia, with a valid email address and shipping address.

The program is not open to:

- Business accounts, resellers, or distributors; or

- Automated or bot-generated accounts.

Participation in Loop Circle constitutes a declaration of compliance with these eligibility requirements. Loop reserves the right to verify eligibility at any time and to suspend or terminate Accounts found to be in violation.

SECTION 5 - LOOP CIRCLE REWARD PROGRAM

When you have registered for Loop Circle Reward program, you can collect a certain number of Points by referring a friend, leaving a review, and following Us on social media channels, to unlock exclusive Rewards. The more you level up, the more you can unlock, including sneak peeks, early access to Members-only products, giveaways, discounts, and more.

To cancel your Loop Circle Account, please contact Us by sending an email to community@loopearplugs.com with "Delete Loop Circle account" as the subject line. Please note that deleting your Loop Circle Account will also result in the deletion of associated data, including earned Points and Rewards.

SECTION 6 - MEMBERSHIP LEVELS

The Loop Circle Reward program comprises four levels of membership which you can achieve or acquire: Looper, Explorer, Innovator, and Visionary.

You always have access to the personalised tools in your Account and to specific Benefits, depending on the level you have reached. This list is not restrictive and the Terms and Conditions may be modified at any time.

c) Innovator:

d) Visionary:

- 250 Points on your birthday and a Reward

- Exclusive giveaways

- Members-only early access and discounts

- An accessory discount

- A free pair of Loop Quiet 2 earplugs and Experience 2 Plus earplugs

- Free standard shipping

- The chance to test new products first

- Priority access to our Customer Happiness team

 

SECTION 7 - POINTS AND BENEFITS

Points can only be used to redeem Benefits, such as discounts, in accordance with the applicable terms and conditions. They are not means of payment and cannot be used for any other transactions between yourself and Loop. Points cannot be exchanged for any monetary compensation or other products, either with Loop or with a third party.

By using and exchanging the accumulated Points, you can redeem discounts on the purchase price of Our products (i.e. not a discount of the overall order payable):

- 250 Points = 10 AUD discount

- 500 Points = 15 AUD discount

- 750 Points = 25 AUD discount

- 850 Points = 30 AUD discount

- 1,500 Points = 65 AUD discount

 

These discount amounts are valid for purchases made in AUD. Discount values may vary by region. Discount coupons generated via point redemption can be applied at checkout on eligible purchases and are accessible through your Loop Circle dashboard.

 

You can redeem discounts using the Points you have collected for a period of validity of one year. You can check the expiry date of the Points that will lapse in your Loop Circle dashboard at any time. After this period of validity, or if your registration is terminated, the unused Points will expire and you will no longer be able to use or redeem them.

While Points are subject to expiration as detailed above, your membership level within the Loop Circle Reward program is not subject to expiration.

Points are not transferable (even in the event of the termination of the Loop Circle Reward program for any reason whatsoever) and are solely intended for own use.

You acknowledge that there is no economic relationship between a certain number of Points and the value of the Benefit to which you are entitled, or the value of the transaction or event that leads you to obtain Points. You do not acquire any right resulting from any inconsistency or discrepancy between these values and the number of Points.

Rewards and discounts obtained through the redemption of Loop Circle Points may not be combined or “stacked” with other rewards or discounts derived from the same loyalty program in a single transaction. Each purchase may only be subject to one (1) loyalty-based deduction, whether in the form of a point redemption or other Member-exclusive offer.

Furthermore, rewards or discounts granted under the Loop Circle program cannot be used in conjunction with other promotional campaigns offered by Loop (e.g. sitewide discounts, limited offers, or discount codes), unless expressly stated otherwise. Notwithstanding the foregoing, free shipping promotions may be combined with Loop Circle discounts unless otherwise specified.

SECTION 8 - PRIVACY

Your submission of personal information is governed by Our Privacy Policy.

SECTION 9 - FRAUD, ABUSE AND MISUSE

Loop reserves the right to investigate and take any necessary action (including but not limited to account suspension or permanent termination) in cases where point accumulation or redemption is found to be abusive, misleading, fraudulent, or obtained through misuse of the program, including but not limited to:

 

- Use of multiple Accounts for point generation;

- Attempted resale of Benefits or Rewards;

- Exploitation of program errors, hacks, or third-party tools.

 

Points or Rewards earned through such activity may be revoked without notice.

 

SECTION 10 - LIABILITY

Loop cannot guarantee that the service relating to the Loop Circle Reward program will be available at all times. We reserve the right to refuse access to the service temporarily or permanently, among other things for security reasons. Loop is not obliged to justify such refusal.

You are liable for all damage caused by or a consequence of the improper use of the Loop Circle Reward program (including of your Account) by you.

To the maximum extent permitted by law, Loop, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise. This applies to damages arising from your use of the Loop Circle Reward program, or any other claim related to your use of the Loop Circle Reward program, including, but not limited to, errors or omissions in content, or any loss or damage resulting from the use or content made available via the Loop Circle Reward program, even if advised of the possibility of such damages.

The foregoing liability limitations do not apply to claims arising from fraudulent intent, fraudulent concealment of defects, gross negligence, claims under the Product Liability Act, or damages related to injury to life, body or health.

SECTION 11 - MISCELLANEOUS

Any new features or tools added to the website will also be subject to these Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the Loop Circle Reward program following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

If any provision of these Terms and Conditions is found to be unlawful, void or unenforceable, that provision will still be enforceable to the maximum extent permitted by law, and the unenforceable portion will be deemed severed from these Terms and Conditions. This will not affect the validity and enforceability of the remaining provisions.

Any disputes arising from or related to the use of the Loop Circle Reward program shall be governed by and construed in accordance with the laws of Belgium. Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the courts of Antwerp, Belgium. By accepting these Terms and Conditions, you consent to the exclusive jurisdiction and venue of such courts in any such legal action or proceeding.
